This Privacy Policy is offered by Everytown for Gun Safety Action Fund, Inc., which includes our volunteer grassroots networks of Moms Demand Action for Gun Sense in America and Students Demand Action, and our related organizations, Everytown for Gun Safety Victory Fund and Everytown for Gun Safety Support Fund, Inc. (collectively “Everytown” “we,” “us,” or “our”) to describe the information collection, use, and disclosure practices of our websites (“Sites”) and our mobile applications (“Apps”) that link to this Privacy Policy (together, the “Platforms”), as well as for the information that we receive through other channels like postal mail or in person.

Information Collection

When you use the Platforms or otherwise interact with us, we may collect certain personal information, such as your name, email address, postal address, telephone number, student or educator status, payment card information, or other information you choose to provide. You may provide this information, for example, when you send a donation, register with the Platforms, RSVP for an event, respond to a feedback form, post content, participate in discussions, submit your story, make a purchase, or send a message (including tell-a-friend messages). If you register with the Platforms, you may be asked to create a username and password. We may combine the information you provide through the Platforms with any information you provide to us through other channels or with information about you from third parties.

When you interact with us and provide information, your personal information, including your email, will be added to our mailing list. Additionally, our Apps may request access to your calendar to facilitate your RSVPs and event participation.

If you apply for a job or volunteer position with us, we will collect information during the application process, including your contact information, educational and work history, and demographic information, and other information that you submit about yourself.

We (or third parties as described below) may also collect technical information about your visit to our Platforms, such as your domain name, IP address, browser type, device identifier, activities on the Platforms, and date and time of your visit. We may use your IP address to derive your device’s general location. Our Apps may collect information about the precise location of your mobile device if you enable location services and grant permission. Additionally, the Platforms may include chatbot functionalities or similar tools, operated by us or a third party. These technology tools (and the third parties that operate them) may record and use your communications in order to better respond to your inquiries and train or improve these technologies.

Information Use

We may use the information we collect for any lawful purpose, such as to:

  • respond to your requests and send you notifications and reminders;
  • respond to your questions about our work;
  • conduct research, train our tools, and improve our responses;
  • request donations and support, and to process donations and payments;
  • mobilize and provide information to volunteers;
  • fulfill your orders;
  • send information to you about Everytown or other organizations we think may be of interest to you including delivering advertising and serving and improving targeted advertising and participating in data sharing arrangements to identify prospective donors;
  • generate directions to events and send reminders;
  • operate and improve the Platforms, customize your experience across the Platforms, and for account creation and management;
  • comply with applicable law;
  • identify or remedy potential threats to the Platforms, security;
  • conduct research about your use of the Platforms and our products and programs; and
  • With your consent or for any other purpose stated at the time of collection.

Cookies

Portions of the Platforms are cookie-enabled to give you a more customized user experience. A cookie is a small piece of information that a website can store on a device and later use to recognize a user. A purpose of cookies is to enhance your ability to receive the information you want. We use two types of cookies to enhance the experience of users: session cookies and persistent cookies. A session cookie expires when a user closes the browser in which this website was viewed. A persistent cookie expires on a pre-determined date. You may be able to personalize your browser settings to reject cookies, although certain features of the Platforms may not function as intended. Information Sharing

Some parts of the Platforms allow you to interact with others, to take certain actions (like contacting a legislator), or to participate in public forums. When you participate in these features, such as by posting, commenting, or saving or taking actions, the information that you provide, such as your name, email address, or username, will be available to other visitors to the Platforms and/or the general public.

We may share personal information with our affiliates, such as other Everytown organizations.

We may share personal information to provide services that you request. For example, we may share personal information with organizations hosting events when you RSVP. Additionally, we may share your address with third party services, like Google Maps or Apple Maps, to generate directions to events for you. When we share information with such other entities, it will be governed by their privacy policies.

We may share personal information with third parties who support our work. This may include sharing information about your donations and purchases with third parties that provide marketing analytics services to us or engaging third parties who provide targeted advertising services. As a result of this sharing, such other entities will be able to send you more relevant offers if you already have a relationship with them. Please see “Your Choices” below for more information on opting out of such sharing.

From time to time, we may send you information from or share your personal information with other non-affiliated organizations we think you might find interesting. When we share information with such organizations, it will be governed by their privacy policies. Please see “Your Choices” below for information on opting out of such sharing.

If we or some or all of our assets are acquired by another organization, such as through a merger, acquisition, or bankruptcy, that organization will possess the information collected by us, and it will assume the rights and obligations regarding your information as described in this Privacy Policy.

We may disclose personal information or other data to comply with the law or legal requirements, enforce or apply our Terms of Use and other agreements, or protect our rights, property, or safety of our users or others.

We may share information that has been de-identified or aggregated, or any other technical information, without limitation.

For your convenience, the Platforms may contain certain hyperlinks to other websites or apps offered by third parties. We make no promises or guarantees regarding data collection on any hyperlinked websites and apps that are not operated by Everytown.

The Platforms may also include tools offered by third parties, such as our donations page; and social media tools or “plug-ins” from third parties, such as social networking and video streaming tools. If you create accounts with these third parties, use their tools on our Platforms, or otherwise interact with these third parties on the Platforms, the third parties may collect, use, and share such information in accordance with your account settings, including by sharing such information with the general public. These third-party partners may also provide your information to us for our own use.

Your interactions with third-party entities and your use of their features, websites, and apps are governed by the privacy notices of those third-party entities. We encourage you to carefully read the privacy notices of any accounts and tools that you use.

Your Choices

You can unsubscribe from any Everytown emailing list at any time by following the instructions included within any email you receive from us.

If you opt out of our email marketing, we will still send you messages related to our transactions and relationship with you, such as order confirmations. For choices with respect to third-party interest-based advertising activities, please see the “Analytics & Interest-Based Advertising” section below.

Analytics and Interest-Based Advertising

We may work with third parties to serve more relevant online ads to you based on information we collect about you and information those third parties collect about your activities on our Platforms and across other websites and apps over time, including on different devices. We adhere to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles in connection with this activity. You may visit www.aboutads.info to learn more about such Interest-Based Advertising (“IBA”) and how to opt-out of this type of advertising by companies participating in the DAA self-regulatory program. You can also exercise choices regarding interest-based advertising on your mobile device by downloading the appropriate version of the DAA’s AppChoices tool at https://youradchoices.com/appchoices. To opt out of IBA from participating members of the Network Advertising Initiative, you may visit www.networkadvertising.org. We may also work with third parties that collect data about your use of the Service and other websites or apps over time for non-advertising purposes. U.S. State Privacy Rights

Personal Information We Collect.  Everytown collects the categories of personal information described in the section above entitled “Information Collection

Our Purposes for Processing Personal Information.  We use and disclose the personal information we collect for our processing purposes, as further described above in the “Information Use” section of this Privacy Policy.

We may use and share deidentified information to the extent permitted by applicable law. When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it.

Recipients of Personal Information.  We disclose the categories of personal information designated above to the categories of third parties described in the “Information Sharing” section of this Privacy Policy.

Your Rights.  You may have rights with respect to the personal information we collect, depending on your state of residence. You may be able exercise the following rights regarding personal information, subject to certain exceptions and limitations:

  • The right to confirm whether we are processing personal information about you.
  • The right to access the categories and specific pieces of personal information we collect and maintain about you.
  • Depending on your state, the right to access a list of the specific third parties to which we have disclosed personal information.
  • The right to receive a portable and readily usable copy of the personal information we collect and maintain about you, to the extent feasible. 
  • The right to correct inaccuracies in the personal information we have collected about you. 
  • The right to request that we delete the personal information we have collected about you.
  • The right to opt out of processing personal information for the purposes of (i) targeted advertising; (ii) the sale of personal information; or (iii) profiling for decisions that have significant effects. Please note that if you opt out of certain practices, we may be unable to provide you with some services.
  • Choice regarding processing of sensitive data. Depending on your state law, you can:
    • Opt out of our processing of certain “sensitive” information; or
    • Withdraw consent for such processing if you previously gave it.
  • The right not to receive discriminatory treatment for the exercise of the above privacy rights.

Authorized Agent.  Depending on your state law, you may designate an authorized agent to make requests on your behalf by designating such an agent in writing or through a power of attorney. We will require the agent to provide us with proof that you have authorized the agent to make requests on your behalf prior to accepting requests from the agent.

Appeals.  Additionally, if you have submitted a request that we have not reasonably fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to [email protected] .

Authentication Process and Required Information.  Note that we may need to request additional information from you or from your authorized agent to authenticate your identity, to authenticate your agent’s authorization to act on your behalf, or to understand the scope of your request. You will not be required to create an account with us to submit a request or have it fulfilled. We will require you to provide, at a minimum, basic contact information, like your name and phone number or email address.

Retention. We retain personal information in identifiable form only for as long as necessary to fulfill the purposes for which the personal information was provided to us or, if longer, to comply with legal obligations, to resolve disputes, to enforce agreements, or to satisfy any similar essential purposes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process personal information, and whether we can achieve those purposes through other means, and the applicable legal requirements. Once the retention period expires and if not otherwise required to retain information by law, we will delete or de-identify personal information.

You may request to review, change, or update your contact information previously provided to us, by emailing us at [email protected]. You may also review, change, or update your contact information previously provided on our Apps by amending your profile on the Apps.

From time to time, we may update this Privacy Policy by updating this webpage and revising the effective date at the top of the page. If we make any material changes to our privacy practices, we will indicate within this Privacy Policy the date when it was most recently updated, and we shall provide appropriate notice of such material changes.
