Bill Introduced Today by Senator Richard Blumenthal (D-CT) and Representative Adam Schiff (D-CA) Would Repeal 2005 Protection of Lawful Commerce in Arms Act), the NRA’s “Most Significant Piece of Pro-Gun Legislation in Twenty Years”
NEW YORK – Everytown for Gun Safety today applauded the introduction of legislation by Senator Richard Blumenthal (D-CT) and Representative Adam Schiff (D-CA) that would repeal the 2005 Protection of Lawful Commerce in Arms Act, or PLCAA, which the NRA called the “most significant piece of pro-gun legislation in twenty years” at the time of its passage.
“No industry should be above the law, especially one that produces deadly weapons — and yet America’s gun industry enjoys special protection from lawsuits thanks to the millions of dollars they spent lobbying politicians,” said John Feinblatt, president of Everytown for Gun Safety. “We applaud Senator Blumenthal and Representative Schiff for taking action to repeal PLCAA and allow the courts to hold reckless gun manufacturers and gun dealers accountable.”
Additional Information About the Protection of Lawful Commerce in Arms Act:
1. Passed in 2005, it gives gun dealers and manufacturers special legal protections from accountability under the law.
2. The law provides broad immunity from civil lawsuits for gun dealers and manufacturers, even if they don’t properly secure guns that wind up stolen, or look the other way when gun traffickers buy guns, and then flood them into the black market where they’re used in gun crimes.
3. With immunity from the law, gun makers can ignore repercussions of their business practices, including gun trafficking and transfers to felons or other prohibited people.
